Yes he could ;). Subjunctive would maybe be better in that case, as there is
nobody identified, but I think almost every one would *say* (and not *write*
;)) "peut" (maybe like "I wish I were" vs "I wish I was" ??) .
However, intuitively, I'd better say "avec qui" than "avec lequel", as "personne" 'no
one' doesn't refer to any one. But if you have a particular reference, I think
it's better (when you write) to use "lequel" as :
1.a. L'homme avec lequel je marche 'the man who I'm walking with.

But (1.b) is quite correct when informal (spoken) language :
1.b. L'homme avec qui je marche.
